What Is a Removal Proceeding?

After a person is detained by ICE, removal proceedings are initiated to determine whether the person will be removed. The immigrant, called the respondent, receives a Notice to Appear (NTA) from ICE, part of the federal government’s Department of Homeland Security.

An immigration judge presides over proceedings and considers evidence and arguments presented by both the respondent and an attorney from ICE’s Office of the Principal Legal Advisor, known as Chief Counsel. The judge then issues a decision terminating proceedings, granting relief from removal, or ordering removal. The respondent can appeal an unfavorable ruling to the Board of Immigration Appeals, and from there, to the appropriate circuit of the United States Courts of Appeals.
